Terms of Service

Introduction

KonnectWI(the “Platform” the “Site”) is an online booking marketplace owned and operated by Procurement & Logistics Service Grenada Ltd. ("PLS Grenada," "Company"). These Terms of Service ("Terms") set out the terms on which PLS Grenada offers you access to and use of its Services and governs your access to and use of this Platform, which facilitates the listing and booking of various items (collectively “Services”) between users ("Users"). By accessing or using this Platform, you agree to comply with all Terms of this agreement and to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Platform.

Read this User Agreement carefully as it contains provisions that govern how claims you and we have against each other are resolved.

1. User Accounts

Account Creation: To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Eligibility: You must be at least 18 years old and have the legal capacity to enter into these Terms to create an account and use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.

Account Suspension and Termination: PLS Grenada reserves the right to suspend or terminate your account at any time for any reason, including but not limited to: (a) violation of these Terms; (b) fraudulent or abusive activity; (c) inactivity; or (d) as required by law.

2. Your Privacy

We know your personal information is important. Our Privacy Policy details how your information is collected, used and shared when you use our Services. By using our Services, you acknowledge and agree to be bound by the terms of our Privacy Policy.

3. Listings and Bookings

Listing Items: Users may list items for booking on the Platform in accordance with these Terms and any applicable listing guidelines. You are solely responsible for the accuracy and legality of your listings. PLS Grenada reserves the right to remove or reject any listing at its discretion.

When listing you assume full responsibility for the item offered and the accuracy and content of the listing, including listing content created using tools offered by PLS Grenada. Your listing may not be immediately searchable by keyword or category for several hours (or up to 24 hours in some circumstances). Content that violates any of PLS Grenada's policies may be modified, obfuscated, or deleted at PLS Grenada's sole discretion. You will not sell and will promptly remove all listings for any product recalled by a manufacturer or governmental agency if the sale of the product is prohibited by law or regulation or if the product poses a health or safety hazard as specified by any governmental agency. PLS Grenada has no responsibility or liability for the safety or performance of any product that you list or sell using our Services, including any product that is subject to a recall. You are solely responsible for any non-conformity or defect in, or compliance with any public or private recall of, any product you list or sell using our Services.

Transactions: Users are solely responsible for all communications, agreements, and transactions with other Users. PLS Grenada is not a party to any booking agreements and does not guarantee the quality, safety, or legality of listed items or the performance of Users.

Prohibited Items: Users may not list or book prohibited items, including but not limited to: (a) illegal items; (b) weapons; (c) hazardous materials; (d) stolen goods; and (e) items that infringe intellectual property rights.

4. Fees and Payments

Fees: PLS Grenada may charge fees for certain features or services on the Platform, such as booking fees, transaction fees, or premium features. The current fee schedule is available on the Platform.

You are responsible for paying all fees that you owe to PLS Grenada. Except as set forth below, you are also solely responsible for collecting and/or paying any applicable taxes for any purchases or sales you make through our Services. Where applicable, PLS Grenada will calculate, collect and remit value-added tax or VAT to the user.

Payments:All payments must be made through the Platform's designated payment processor. You agree to provide accurate and complete payment information. KonnectWI is not responsible for any errors or issues with payment processing.

1. Standard Bookings:

For standard bookings, the Customer must provide payment for the total price of the booking at the time the request is submitted. However, a booking is only considered "Accepted" once the Service Provider manually reviews and confirms the request via the Platform. Upon Service Provider acceptance, we will send a confirmation email to the address provided. Only at this point does a legally binding contract between the Service Provider and the Customer come into existence. If a Service Provider declines the request, the payment authorization will be canceled or refunded in full.

2. KonnectWI Flex:

An automated installment payment option exclusively for long-term bookings and customers who are credit card holders. KonnectWI provides financial flexibility to customers while maintaining a high level of payment security and reliability. Credit card will be charge monthly or Bi-Weekly on a recurring basis when using KonnectWI Flex.

3. Flat-Price Service Bookings:

For listings designated as "Flat-Price Services," the booking follows a two-stage confirmation process:

  • Booking Acceptance:The Customer's payment method is authorized (but not captured) when the request is submitted. A legally binding contract is formed only once the Service Provider explicitly accepts the booking.
  • Service Completion & Capture: Funds are captured only after the service is rendered.

Customer Confirmation:Upon service completion, the Customer and Service Provider are required to confirm fulfillment via the Platform to trigger the release of authorized funds to the Service Provider. If the Customer fails to confirm within 48 hours of the Service Provider marking the service as "Complete” the Platform will automatically process the payment.

Price: The prices payable for bookings are as set out in our Platform.

5. User Content

Ownership: Users retain ownership of their content (e.g., listings, reviews, photos) submitted to the Platform. By submitting content, you grant PLS Grenada a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display the content in connection with the Platform and its services.

Content Guidelines:Users must comply with the Platform's content guidelines, which prohibit the submission of offensive, harmful, or illegal content. PLS Grenada reserves the right to remove any content that violates these guidelines.

6. Cancellation policy

This Cancellation Policy applies to all bookings made on KonnectWI. By making a booking, you agree to the terms outlined below.

Cancellation by Buyer

Customers may cancel their booking at any time, subject to the following conditions:

  • Full refund if canceled up to 48 hours before the start of the booking period.
  • 50% refund if canceled within 12 to 48 hours of the start of the booking period. 50% will be given to the Service Provider for any inconvenience caused.
  • No refund if canceled 12 hours before or during the booking period whether or not the item or service has begun the delivery process.
  • Full refund if a booking is made within 12 hours of the booking start time.

Cancellation by Seller

Service Providers may cancel bookings in limited circumstances, such as:

  • The property becomes unavailable due to unforeseen circumstances (e.g., damage, sale).
  • The Buyer violates the terms of service or platform policies.

In the event of a Service Provider cancellation, Customers will receive a full refund and KonnectWI will assist in finding alternative accommodations if possible.

Extenuating Circumstances

KonnectWI may consider exceptions to the cancellation policy in extenuating circumstances, such as natural disasters, emergencies, or serious illnesses. Documentation may be required to support such claims.

Cancellation Process

To cancel a booking, Users must log in to their account and follow the cancellation instructions provided.

Cancellation Policy Changes

PLS Grenada reserves the right to modify this Cancellation Policy at any time. Changes will be effective immediately upon posting on the platform.

Cancellation Disputes

Any disputes arising from cancellations will be handled in accordance with the KonnectWI Dispute Resolution Policy.

7. Refund Policy

This Refund Policy outlines the terms and conditions for refunds on the platform. By using our platform, you agree to adhere to this policy.

General Refund Principles:

Refunds are processed based on the specific circumstances of each booking and in accordance with the Service Provider's individual cancellation policy, as displayed on their listing terms and conditions.

KonnectWI acts as a facilitator and payment processor. We are not responsible for Service Provider-specific cancellation policies or disputes arising from booking agreements.

All refund requests must be submitted through the Service Provider.

Platform Fees:

Booking fees are non-refundable. These fees cover the costs associated with platform maintenance, payment processing, customer support, and other services provided by KonnectWI.

Regardless of the reason for cancellation or refund, the booking fee will not be refunded to the customer.

8. Subscription Management and Billing

Subscription Period Commencement

Subscription periods for KonnectWI's paid services commence on the date payment is successfully processed by Procurement & Logistics Services Grenada Ltd. This rule applies to:

  • The start of an initial paid subscription.
  • The effective date of an upgrade from one paid subscription plan to another paid subscription plan.

Subscription Upgrades

When a User chooses to upgrade their current paid subscription to a higher-tier paid subscription, the new plan's terms and billing begin immediately upon successful payment. In such cases, no refunds will be provided for any remaining time or portion of the previously paid subscription period. The User is responsible for the full cost of the new, upgraded subscription from the date of purchase.

Automatic Renewal

All monthly subscriptions are automatically renewed for successive monthly periods unless the User unsubscribes from the service before the next scheduled monthly billing date. By maintaining an active paid subscription, the User authorizes KonnectWI to charge the applicable subscription fees to the payment method on file on each renewal date.

Cancellation Policy

Users may cancel their paid subscription at any time by selecting the “Unsubscribe” option provided within the KonnectWI dashboard.

Any request to unsubscribe will take effect at the conclusion of the current monthly subscription period, regardless of when the request is made during that term.

No refunds or prorated credits will be issued for cancellations made mid-term. The User will retain access to the paid subscription features until the end of the already-paid monthly cycle.

To prevent being charged for the next period, please unsubscribe prior to the next automatic monthly billing date.

Policy Enforcement

When a user issue arises, we may consider the user's performance history and the specific circumstances in applying our policies. We may choose to be more lenient with policy enforcement in an effort to do the right thing for both buyers and sellers. The foregoing does not limit or impair our right to refuse, modify, or terminate all or part of our Services to anyone, or to terminate this agreement with anyone, for any reason at our discretion.

9. Dispute Resolution

KonnectWI is committed to providing a safe and fair environment for all users. This Dispute Resolution Policy outlines the process for resolving disputes that may arise between Customers and Service Providers on the platform.

Types of Disputes

This policy applies to disputes related to:

  • Bookings: Issues related to booking confirmations, cancellations, changes, and refunds.
  • Property Condition: Discrepancies between the listing description and the actual condition of the property.
  • Payments: Disagreements regarding payments, security deposits, and refunds.
  • Service Provider or Customer Conduct: Violations of platform policies, terms of service, or booking agreements.

Dispute Resolution Process

a) Direct Communication:

  • Initial Contact: We encourage Customers and Service Providers to communicate directly with each other to try and resolve the issue amicably. The platform provides a secure messaging system for this purpose.

b) Platform Mediation:

  • Request for Mediation: If direct communication fails, either party can submit a request for mediation to support@plsgrenada.com.
  • Evidence Submission: Both parties will have the opportunity to submit evidence relevant to the dispute, such as messages, photos, and documentation.
  • Mediator Review: A trained KonnectWI Mediator will review the evidence and communicate with both parties to facilitate a resolution.
  • Mediation Outcome: The mediator will propose a fair and reasonable solution based on the evidence and platform policies.

Escalation to Legal Action

If the dispute cannot be resolved through the above processes, either party may pursue legal action. KonnectWI may cooperate with legal authorities as required by law.

Record Keeping

KonnectWI will maintain records of all disputes and their resolution outcomes for a reasonable period.

Policy Changes

PLS Grenada reserves the right to modify this Dispute Resolution Policy at any time. Changes will be effective immediately upon posting on the platform.

Important Notes:

  • This policy is intended to provide a fair and efficient process for resolving disputes.
  • KonnectWI encourages users to act in good faith and cooperate throughout the dispute resolution process.
  • This policy is subject to the laws of Grenada.

10. Intellectual Property

Platform Ownership: The Platform and its content, including but not limited to text, graphics, logos, images, and software, are the property of PLS Grenada or its licensors and are protected by intellectual property laws.

Limited License:PLS Grenada grants you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not modify, reproduce, distribute, or create derivative works of the Platform without PLS Grenada's express written consent.

11. Disclaimers and Limitations of Liability

Platform "As Is":The Platform is provided "as is" and without warranties of any kind, express or implied. PLS Grenada disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

No Liability for User Interactions: PLS Grenada is not liable for any disputes, claims, losses, or damages arising from interactions between Users or the use of listed items. Users are solely responsible for their interactions and transactions on the Platform.

Limitation of Liability:To the maximum extent permitted by law, PLS Grenada's liability for any claims arising out of or related to these Terms or the Platform shall be limited to the amount of fees paid by you to PLS Grenada in the six (6) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless PLS Grenada and its affiliates, officers, directors, employees, and agents from any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your content or (e) your breach of any law or the rights of a third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Grenada. Any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Grenada.

14. Amendments

PLS Grenada reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform with an effective date. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes. We will provide you with 30 days' notice by posting the amended terms. If you do not agree with the changes, you may close your account.

15. Entire Agreement

These Terms constitute the entire agreement between you and PLS Grenada relating to the Platform and supersede all prior or contemporaneous communications and proposals, whether oral or written.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

18. Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision, and PLS Grenada's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. We do not guarantee we will take action against all breaches of these Terms.

19. General

Headings are for reference purposes only and do not limit the scope or extent of such sections.

Without limiting PLS Grenada's ability to refuse, modify, or terminate all or part of our Services, PLS Grenada may also terminate this Agreement with anyone at any time for any reason, at our sole discretion, by giving notice of such termination.

If you create or use an account on behalf of a business entity, you represent that you are authorized to act on behalf of such business and bind the business to these Terms of Service. Such an account is owned and controlled by the business entity. No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this User Agreement.
